These Terms of Service (“Terms”) govern your use of the ARTIFANA website (the “Site”), owned and operated by ARTIFANA (“we”, “us”, or “our”), and your purchase of our products, including Wool Coats, Satin Dresses, Knitted Sweaters, and High-Waisted Denim (the “Products”). By accessing, browsing, or using the Site, or purchasing any Products, you (“you” or “user”) agree to be bound by these Terms, effective as of March 22, 2026. If you do not agree to these Terms, please do not use the Site or purchase our Products.
1. Acceptance of Terms
By using the Site, creating an account, or completing a purchase, you confirm that you have read, understood, and agree to comply with these Terms, as well as our Privacy Policy and Shipping & Returns Policy, which are incorporated herein by reference. We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site or purchase of Products after such changes constitutes your acceptance of the modified Terms.
2. Eligibility
To use the Site and purchase Products, you must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. By using the Site, you represent and warrant that you meet these eligibility requirements. Slight variations in color, fabric, or fit may occur due to manufacturing processes, screen display differences, or other factors. If a Product you have ordered is unavailable, we will notify you promptly and offer a refund or alternative Product (if available).
Our Products include Wool Coats, Satin Dresses, Knitted Sweaters, and High-Waisted Denim, each designed to meet high-quality standards. Product care instructions are provided on each Product page; you agree to follow these instructions to maintain the quality and condition of the Products.
5. Orders and Payments
When you place an order on the Site, you are making an offer to purchase the Products at the stated price, subject to these Terms. We reserve the right to accept or reject any order in our sole discretion, including but not limited to orders that contain incorrect pricing, incomplete information, or orders for Products that are unavailable. If we accept your order, we will send you a confirmation email with details of your order (the “Order Confirmation”). The contract between you and us is formed when we send the Order Confirmation.
All payments must be made using the payment methods accepted on the Site (e.g., credit card, PayPal). You agree to provide valid and accurate payment information, and you authorize us to charge the total amount of your order (including taxes, shipping fees, and other applicable charges) to your chosen payment method. Prices are displayed in USD or EUR (depending on your location) and do not include taxes or shipping fees, which will be added to your order total at checkout. 6. Shipping and Delivery

We ship to locations in the United States and European Union, and delivery times may vary depending on your location. We will provide you with a tracking number once your order has been shipped. Risk of loss or damage to the Products passes to you upon delivery. We are not responsible for delays or failures in delivery caused by third-party shipping carriers, customs delays, or unforeseen circumstances.
7. Returns and Refunds
Returns and refunds are governed by our separate Returns Policy, which is incorporated herein by reference. You may return Products within the specified return period (as set forth in the Returns Policy) if they are unused, in their original packaging, and in the same condition as when you received them. Custom or personalized Products are not eligible for return unless they are defective. We reserve the right to inspect returned Products and deny refunds if they do not meet these requirements.
In accordance with EU consumer law, you have a 14-day right of withdrawal from the date of delivery, during which you may return Products without providing a reason . If you exercise this right, we will process your refund within a reasonable timeframe, excluding shipping costs.
8. Intellectual Property
All intellectual property rights in the Site (including but not limited to text, graphics, logos, images, Product designs, and software) and the Products are owned by or licensed to ARTIFANA. You may not copy, reproduce, distribute, modify, display, or use any of these intellectual property rights without our prior written permission. This includes, but is not limited to, copying Product images or descriptions for use on other websites or platforms. Unauthorized use of our intellectual property may violate copyright, trademark, and other laws, and we reserve the right to take legal action against such unauthorized use .
9. Limitation of Liability
To the maximum extent permitted by law, ARTIFANA shall not be liable for any indirect, incidental, consequential, or special damages (including but not limited to loss of profits, loss of data, or damage to reputation) arising out of or in connection with your use of the Site, purchase of Products, or these Terms. Our total liability to you for any direct damages shall not exceed the total amount you paid for the Products giving rise to the liability.
We shall not be liable for any damages caused by delays in delivery, defects in Products (except as provided in our Warranty Policy), or any errors in Product information, unless such damages are caused by our gross negligence or willful misconduct. Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law .
10. Warranty
We warrant that our Products are free from defects in materials and workmanship for a period of 30 days from the date of delivery. If a Product is defective within this period, please contact us to arrange a replacement or refund (in accordance with our Returns Policy). This warranty does not cover damages caused by normal wear and tear, improper care, misuse, or modification of the Product. Any implied warranties (including merchantability and fitness for a particular purpose) are limited to the 30-day warranty period, to the maximum extent permitted by law .
In compliance with EU Directive (EU) 2019/771, we ensure that all Products conform to the sales contract and are fit for their intended use .
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, for users in the United States, and the laws of Belgium (as a representative EU member state) for users in the European Union, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms, the Site, or the purchase of Products shall first be resolved through good-faith negotiation between you and us. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (for U.S. users) or the International Chamber of Commerce (for EU users), with the arbitration taking place in Los Angeles, California (U.S. users) or Brussels, Belgium (EU users). The arbitration award shall be final and binding on both parties.
For EU users, nothing in these Terms shall affect your statutory rights under EU consumer protection laws .

You may not assign these Terms or any of your rights or obligations hereunder without our prior written permission. We may assign these Terms to any third party without your consent.
